Terms of service for consumers — carsexport.us
1. About these terms
These terms govern the use of carsexport.us (https://carsexport.us), provided by LynBro ApS, CVR no. 46321499, Rødovre Parkvej 276, 2610 Rødovre, Denmark, email info@lynbro.dk ("we", "us"). "You" means whoever creates an account or otherwise uses the service.
These terms apply when you use carsexport.us as a consumer, i.e. as a private individual and not in the course of your business. You must be at least 18 years old. If you use the service in your business, our terms for business customers apply. Nothing in these terms limits the rights you have under mandatory consumer law.
The agreement consists of these terms, the addendum on auction data. In case of conflict, the addendum prevails over these terms, and these terms prevail over descriptions on the website and the price page. The privacy policy and the cookie policy describe how we process personal data.
These terms exist in Danish, English and Ukrainian. In case of discrepancy the Danish text prevails, unless another reading is more favourable to you under mandatory rules. Previous versions are on the change log page.
2. The service
carsexport.us shows information about vehicles from US car auctions — such as lot data, photos, prices, history and vehicle reports — and indicative calculations of the costs of buying and exporting. The information is provided as is; see the addendum.
The features and limits that apply are described on carsexport.us. We develop the service continuously and may change, replace or remove features, suppliers and technical limits under section 13.
The service is a tool. It is not legal, accounting, tax, financial or other professional advice, and you make your own decisions based on what the service shows.
3. Account and access
You must provide correct and complete information when you create an account and keep it up to date. We may reject a registration or order, e.g. if we suspect abuse; if you have paid, you get your money back.
You must keep passwords, sign-in links, API keys and other credentials secret. You are responsible for what happens under your account, including unauthorised use resulting from credentials that have fallen into the wrong hands on your side, until you have notified us and we have had reasonable time to block access. Write to info@lynbro.dk immediately if you suspect misuse. We may require two-factor authentication and other security measures.
4. Credits, limits and fair use
Plans and features have usage limits, e.g. number of users, requests, messages, minutes, storage or API calls per unit of time, as described on the price page or in the documentation. Items described as "unlimited" also assume normal use for your own private purposes.
We may limit throughput, queue requests, require an upgrade or temporarily block a feature if your use materially exceeds what is normal for comparable customers, burdens the systems, causes disproportionate costs at our suppliers or is automated contrary to the documentation. Where possible we notify you first and give you a reasonable chance to adjust your use.
API keys are credentials under section 3. We may change the API and its limits under section 13 and block keys that are misused or compromised. You may not resell access to the API or the service without a written agreement with us.
5. Free plans, trials and beta features
We may change, limit or close free plans and free features at any time. If we close a free plan entirely, we give you at least 30 days' notice so you can export your data or choose a paid plan. We may close free accounts that have not been used for 12 months after 30 days' notice.
Features labelled beta, test, preview or experimental are provided as they are. They may contain errors, be changed or closed without notice, are not covered by any availability commitment and should not be used for critical purposes. Your mandatory rights as a consumer also apply here.
6. Your content and data
You own the content and data you put into the service. You grant us the right to store, process, copy, display and transfer the content as necessary to provide, secure and improve the service. The right ends when the content is deleted under section 14.
You are responsible for your content and your use of the service being lawful, for having the necessary rights to the content, and for not putting other people's personal data into the service without a lawful basis.
We take backups for operational purposes, but we are not an archive. You should export and keep copies of data that matters to you. We may use anonymised and aggregated data that cannot be traced back to you or other persons for statistics, security and development of our services, also after the agreement ends. We may use suggestions and feedback you give us freely.
7. Acceptable use and content moderation
You may not use the service to:
- break the law or infringe the rights of others, including copyright, trademarks, privacy and marketing rules;
- send spam or electronic communications without the necessary consent, phishing or misleading messages;
- spread malware, attack, scan or load-test the service or other systems without our written permission;
- circumvent security, access controls, payments or usage limits, or create accounts automatically or in bulk;
- copy the service or its data systematically (scraping) to build a competing service, or decompile the service beyond what the law allows;
- impersonate another person or business, harass, threaten or spread hateful or illegal content, including child sexual abuse material;
- use a consumer account for business purposes.
We may remove or block content and restrict or suspend accounts that in our reasonable assessment are illegal or in breach of these terms. We decide on the basis of notices, orders from authorities and our own checks; automated tools may be used to detect spam, fraud and abuse, but decisions to remove content or close accounts are made or reviewed by a human. You receive a statement of reasons unless the law, an authority or security considerations prevent it.
Illegal content can be reported, and you can complain about our decision, by writing to info@lynbro.dk with a precise indication of the content and the reasons. We handle notices and complaints diligently and without undue delay. You may also refer the matter to a certified out-of-court dispute settlement body or to the courts. The same address is the point of contact for authorities and users under the Digital Services Act (DSA); we communicate in Danish and English.
8. Suspension and closure of accounts
We may suspend all or part of your access, a feature or your content, immediately where necessary, if:
- a payment has not been made after a reminder;
- you or your users breach these terms, section 7 or the law;
- there is a risk to the security of the service, other customers or third parties, e.g. compromised credentials, suspected fraud or misuse of telephony, payments or messaging;
- an authority, a court or the law requires it; or
- your use exceeds the limits under section 4 and burdens the service.
Where possible we notify you with reasons before suspending, otherwise immediately afterwards. The suspension is lifted when the cause is removed. In case of material or repeated breach, fraud or illegal content we may close the account with immediate effect. If we close the account because of your breach, you are refunded prepaid amounts for the remaining period to the extent the law requires.
9. Availability, support and maintenance
We aim for the service to be stable and available, but we do not guarantee uninterrupted or error-free operation. We only commit to uptime or response times if expressly stated in a service level agreement (SLA) for your plan.
We carry out maintenance and updates. Planned maintenance expected to cause noticeable interruptions is announced in advance where possible; urgent maintenance for security or operational reasons may happen without notice. We may change the technical requirements for browsers, apps and integrations when developments make it necessary.
Support is provided in Danish and English via info@lynbro.dk.
10. Intellectual property
All rights to the service, including software, design, texts, trademarks and documentation, belong to us or our licensors. You receive a non-exclusive, non-transferable right to use the service during the term of the agreement under these terms.
11. Liability and limitation of liability
We are liable under the general rules of Danish law. If the service is defective, you have the rights Danish law gives consumers for digital services, including the right to have it brought into conformity, a proportionate price reduction and termination. Contact us as soon as possible if you experience an error so that we can fix it.
We are not liable for loss caused by your own content or your own use of the service in breach of these terms, third-party services you choose to connect, misuse of your credentials for which we are not to blame, or circumstances under section 12. To the extent the law allows, we are not liable for indirect loss such as lost profit.
Nothing in this section limits our liability for intent or gross negligence, for personal injury or the rights you have under mandatory consumer law.
12. Force majeure
We are not liable for non-performance or delay caused by circumstances beyond our reasonable control that we should not have foreseen when the agreement was made, e.g. natural disasters, fire, war, terrorism, epidemics, strikes and lockouts, power failure, failure of the internet, telecom networks, data centres, payment systems or other suppliers, cyber attacks despite reasonable security measures, orders from authorities and changes in third-party services or terms beyond our control.
Our obligations are postponed for as long as the circumstance lasts. If it lasts more than 30 days, either of us may terminate the agreement with immediate effect, and you are refunded prepaid amounts for the period not delivered.
13. Changes to the service, prices and terms
We may change the service, the prices and these terms for valid reasons, namely changes in our costs (e.g. at suppliers of hosting, telephony, payments, AI and energy), in taxes and charges, in legislation, case law or requirements of authorities, for security reasons, technological development and changes in third-party services, and when we develop, restructure or close features.
We notify changes to your disadvantage clearly at least 30 days before they take effect by email. We tell you what changes, why, when, and that you may terminate the agreement without cost before the change takes effect. Price changes apply only from the first billing period after the effective date and never to a period you have already paid for.
If we modify the digital service beyond what is necessary to keep it in conformity with the agreement, we do so only for a valid reason under this section and at no extra cost to you. If the modification negatively affects your access to or use of the service more than minimally, you may terminate the agreement free of charge within 30 days after being informed of the modification or after it is made, whichever is later; you then get prepaid amounts for the remaining period back.
Changes solely in your favour may take effect immediately.
Each version of the terms has a version number and a date. We record which version you accepted and when, and previous versions are on the change log page.
14. Term and termination
The agreement runs until terminated. You may terminate at any time by closing your account; ongoing orders and payments are first completed under their own terms. We may terminate the agreement with at least 30 days' notice and in that case refund prepaid amounts for the remaining period. In case of material breach, either party may terminate the agreement with immediate effect.
After termination you can export your data for 30 days where the service allows it. After that we delete it under the privacy policy; copies in backups are deleted with the normal backup cycle and no later than 90 days after. Information we must keep by law, e.g. accounting records, is kept for the period the law requires.
15. Transfer
LynBro ApS may transfer this agreement, including rights and obligations and the personal data processed in connection with the service, to another company as part of a transfer of the service or the part of the business that operates it. You will be notified in writing at least 30 days before the transfer, with the new operator's name and CVR number. The transfer does not change your rights, and you may terminate the agreement free of charge with effect from the date of transfer. Prepaid amounts and balance pass to the new operator.
We may use subcontractors to perform the agreement and are responsible for them as for ourselves under these terms.
16. Notices
We give notices under the agreement by email to the address linked to the account or in the service; they are deemed received when sent or displayed. You must keep your email address up to date. Notices to us are sent to info@lynbro.dk.
17. Governing law and disputes
The agreement is governed by Danish law. The choice of Danish law does not deprive you of the protection of mandatory rules in the country where you live.
If you have a complaint, contact us first at info@lynbro.dk — we usually find a solution. If we cannot agree, you may complain to Nævnenes Hus, Center for Klageløsning and Forbrugerklagenævnet (the Danish Consumer Complaints Board), Toldboden 2, 8800 Viborg, www.naevneneshus.dk, if the conditions for complaining are met. Complaints are filed through the board's complaints portal. If you live in another EU country, you can get help from Forbruger Europa (European Consumer Centre Denmark), Carl Jacobsens Vej 35, 2500 Valby (www.forbrugereuropa.dk). You can also bring proceedings before the ordinary courts under the Danish Administration of Justice Act.
